JGM Fabricators & Erectors Inc. allegedly failed to properly compensate employee

PHILADELPHIA — An individual is suing JGM Fabricators & Erectors Inc., Joseph Messner Jr. and several others for allegedly failing to properly compensate him for his work.

Richard R. Kotowski filed a complaint on April 9 in the U.S. District Court for the Eastern District of Pennsylvania, alleging that the defendants violated the Pennsylvania Wage Payment and Collection Act.

According to the complaint, the plaintiff alleges that he routinely worked 60 to 90 hours per week without receiving overtime wages. The plaintiff holds the defendants responsible for allegedly paying him on a salary basis with no extra compensation for the overtime hours he worked and for allegedly failing to pay his bonus or his accrued paid time off.

The plaintiff requests a trial by jury and seeks unpaid overtime, his unpaid bonus, unpaid paid time off, liquidated damages, interest, litigation costs and any further relief the court deems just and proper. He is represented by James E. Goodley and Ryan McCarthy of Jennings Sigmond PC in Philadelphia.
