PHILADELPHIA — A property owner is suing the Township of Lower Moreland; Sean McCoy, a police officer; and Raymond Mullen, the plaintiff's neighbor, for allegedly depriving him of his rights.
Paul Macolino filed a complaint on April 9 in the U.S. District Court for the Eastern District of Pennsylvania, alleging that the defendants violated the First, Fourth and 14th Amendments of the U.S. Constitution.
According to the complaint, the plaintiff alleges that he was deprived of his rights as a result of the defendants' alleged conduct. The plaintiff holds the defendants responsible for allegedly falsely charging him with two counts of defiant trespass without probable cause. He also holds McCoy responsible for allegedly arresting him without reasonable suspicion that he had committed a crime.
The plaintiff requests a trial by jury and seeks compensatory and punitive damages, attorney's fees, costs and all further relief that is reasonable and just. He is represented by Patrick G. Geckle of Patrick G. Geckle LLC in Philadelphia.
