J.P. Mascaro & Sons accused of firing employee due to his medical disability

PHILADELPHIA — A dump truck driver is suing J.P. Mascaro & Sons, his former employer, for alleged disability discrimination.

Johnny Feliciano filed a complaint on April 11 in the U.S. District Court for the Eastern District of Pennsylvania, alleging that the defendant violated the Americans with Disabilities Act.

According to the complaint, the plaintiff alleges that he was diagnosed with congestive heart failure in 2015. Because of his alleged medical condition, he alleges that he was unable to put liners in his truck bed as ordered by the defendant and was fired on or around Jan. 19, 2017. He claims that he suffered financial damages and emotional distress and/or pain and suffering as a result of losing his job. The plaintiff holds the defendant responsible for allegedly failing to provide him with reasonable accommodation and for allegedly retaliating against him by terminating his employment because of his alleged disability and/or his request for reasonable accommodation.

The plaintiff requests a trial by jury and seeks compensatory and punitive damages, costs and expenses and any other relief the court deems just. He is represented by Jonathan W. Chase of Kraemer, Manes & Associates LLC in Philadelphia.
