Instagram star, ATown, accuses Kicktronics of unfair competition

PHILADELPHIA — An individual is suing Dream Kicks LLC d/b/a Kicktronics, citing alleged unfair competition.

Allen Sherrod, professionally known as "ATown," filed a complaint on April 13 in the U.S. District Court for the Eastern District of Pennsylvania, alleging that the defendant misappropriated his "ATown" trademark and trade name.

According to the complaint, the plaintiff alleges that he is the sole owner of the trade name and trademark "ATown," which allegedly was filed with the U.S. Patent & Trademark Office on May 6, 2016. As a result of the defendant's alleged conduct, the plaintiff claims that he has suffered the loss of goodwill and profits. The plaintiff holds the defendant responsible for allegedly converting approximately 986,000 followers from his Instagram account for its own commercial benefit.

The plaintiff requests a trial by jury and seeks an order requiring the defendant to transfer its Instagram followers to his Instagram account, plus $75,000 in damages, trebles damages, costs, interest, attorney's fees and any further relief that is proper. He is represented by Simon Rosen of the Law Office of Simon Rosen in Philadelphia.
