Former employee of Philadelphia Department of License and Inspections claims that he was fired because of his race

PHILADELPHIA — An Caucasian man is suing a Hispanic woman and an African American woman for alleged racial discrimination.

James Durst filed a complaint on April 13 in the U.S. District Court for the Eastern District of Pennsylvania against Ela Fernandez and Bernice Johnson, alleging that they violated the 14th Amendment of the U.S. Constitution.

According to the complaint, the plaintiff alleges that the defendants terminated his employment as a code inspector for the Philadelphia Department of License and Inspections because of his race. As a result, the plaintiff claims that he has suffered humiliation, financial damages, pain and suffering. The plaintiff holds the defendants responsible for allegedly discriminating against him because of his race, falsifying the findings of his audit and asserting that he committed fraud while inspecting 10 properties.

The plaintiff requests a trial by jury and seeks compensatory and punitive damages, reinstatement, attorney's fees, costs, expenses and any other relief that is proper and appropriate. He is represented by Wayne A. Ely and W. Charles Sipio of Kolman Ely PC in Penndel.
