GMD Roofing Inc. accused of negligence after employees allegedly caused fire

PHILADELPHIA — An insurer is suing GMD Roofing Inc. for alleged breach of implied and express warranties.

Federal Insurance Company, the insurer of Majestic Realty Company, filed a complaint on April 17 in the U.S. District Court for the Eastern District of Pennsylvania, alleging that the defendant violated building codes and regulations.

According to the complaint, the plaintiff alleges that the defendant was hired to do roofing work on a property owned by Majestic Realty Company. On Aug. 10, a fire allegedly broke out on the property due to the negligence of defendant's employees, which allegedly causing more than $5 million in damages. 

The plaintiff claims that it made payments to Majestic for damages and will be obligated to make additional payments in the future. The plaintiff holds the defendant responsible for allegedly failing to exercise reasonable care while overseeing the roofing system that was installed on the property. The plaintiff also holds the defendant responsible for allegedly failing to properly train and supervise its employees.

The plaintiff requests a trial by jury and seeks judgment against the defendant in an amount that exceeds $75,000, plus interest, costs and any further relief the court deems proper. The plaintiff is represented by Mark T. Mullen and Kevin J. Hughes of Cozen O'Connor in Philadelphia.
