HARRISBURG — An individual is suing Encompass Indemnity Company for allegedly breaching an insurance contract.
Robert Cooke filed a complaint on April 17 in the U.S. District Court for the Middle District of Pennsylvania, alleging that the defendant breached its duties of good faith and fair dealing.
According to the complaint, the plaintiff alleges the defendant offered him $10,000 on a $160,000 underinsured motorist claim because it wrongfully determined that his knee injury was not related to a car accident he allegedly was involved in. The plaintiff holds the defendant responsible for allegedly failing to settle his claim in a fair and equitable way.
The plaintiff requests a trial by jury and seeks judgment against the defendant in an amount that exceeds $75,000. He is represented by Patrick J. Doyle Jr. of Anzalone Law Offices LLC in Wilkes-Barre.
