PHILADELPHIA — An individual is suing PayPal Credit, a California company, for allegedly violating telephone harassment statutes.
Ellen Johnson filed a complaint on April 19 in the U.S. District Court for the Eastern District of Pennsylvania, alleging that the defendant intentionally violated the Telephone Consumer Protection Act.
According to the complaint, the plaintiff alleges that she received more than 100 robocalls from the defendant, who allegedly was attempting to collect an alleged debt. As a result, she claims that the defendant wasted her time and harassed, abused and annoyed her. The plaintiff holds the defendant responsible for allegedly calling her several times using an automatic telephone dialing system and/or pre-recorded voice without her prior consent.
The plaintiff requests a trial by jury and seeks actual, statutory and punitive damages and any other just and proper relief. She is represented by Cary L. Flitter, Andrew M. Milz and Jody T. Lopez-Jacobs of Flitter Milz PC in Narbeth.
