City of Johnstown, others accused of wrongfully incarcerating man for 25 years on murder charges

PITTSBURGH — An individual is suing the City of Johnstown, Cambria County, David Tulowitzki, Merrill Brant, Scott Ermlick, Angelo Cancelliere and Lawrence Wagner, citing alleged wrongful conviction and incarceration.

Kevin Siehl filed a complaint on April 19 in the U.S. District Court for the Western District of Pennsylvania, alleging that the defendants made fabricated statements about him killing his wife.

According to the complaint, the plaintiff alleges that he was wrongfully convicted of murdering his wife in 1992, which allegedly resulted in him being imprisoned for 25 years for a crime that he allegedly did not commit. The plaintiff holds the defendants responsible for allegedly failing to submit evidence for DNA testing and ignoring investigative leads that allegedly pointed toward other suspects, including one who allegedly had previously threatened to kill the plaintiff's wife.

The plaintiff requests a trial by jury and seeks compensatory and punitive damages, attorneys’ fees, costs and any other just and appropriate relief. He is represented by Jonathan H.
