Guardian Life Insurance Company of America accused of wrongfully denying disability benefits

PHILADELPHIA — An individual is suing the Guardian Life Insurance Company of America for alleged breach of fiduciary duty.

Denise Rothrock filed a complaint on April 20 in the U.S. District Court for the Eastern District of Pennsylvania, alleging that the defendant violated the Employee Retirement Income Security Act.

According to the complaint, the plaintiff alleges that the defendant wrongfully denied his long-term disability benefits. As a result of the defendant's alleged conduct, he claims that he has suffered financial damages.

The plaintiff requests a trial by jury and seeks an order declaring the he is disabled and entitled to long-term disability benefits, plus attorney's fees, costs, interest and any other relief that is appropriate. He is represented by Mary LeMieux-Fillery of Martin Law in Philadelphia.
