Life Insurance Company of North America accused of wrongfully terminating insurance benefits

PITTSBURGH — An individual is suing Life Insurance Company of North America for allegedly failing to continue her benefits.

Patricia Adkins filed a complaint on April 23 in the U.S. District Court for the Western District of Pennsylvania, alleging that the defendant violated the Employee Retirement Income Security Act of 1974.

According to the complaint, the plaintiff alleges that she stopped receiving her disability benefits on March 2, 2017. As a result, she claims that she was forced to withdraw a significant portion of her 401K account to cover her living and medical expenses. The plaintiff holds the defendant responsible for allegedly wrongfully terminating her benefits by failing to consider her entire medical file and rely upon the evidence provided by her treating physicians.

The plaintiff requests a trial by jury and seeks an order requiring the defendant to provide with her the relief that she is entitled to under ERISA, plus pre- and post-judgment interest and any other just and reasonable relief.
