Continuum Pediatric Nursing Services Inc. allegedly fired employee because of her lower back problems

PITTSBURGH — An individual is suing her former employer, Continuum Pediatric Nursing Services Inc., for alleged disability discrimination, retaliation and wrongful termination.

Sally J. Lust filed a complaint on April 25 in the U.S. District Court for the Western District of Pennsylvania, alleging that the defendant violated the Americans with Disabilities Act and the Pennsylvania Human Relations Act.

According to the complaint, the plaintiff alleges that she was fired from her job while she was on medical leave due to alleged back spasms. As a result, the plaintiff claims that she has suffered financial damages, emotional distress and humiliation. The plaintiff holds the defendant responsible for allegedly firing her because of her disability, requesting a chair that would not hurt her back and taking medical leave to treat her chronic lower back spasms.

The plaintiff requests a trial by jury and seeks all damages, plus reinstatement, pre-judgment interest, attorney’s fees, costs and any other legal and equitable relief. She is represented by Lawrence D. Kerr and Claire E. Throckmorton of Tremba, Kinney, Greiner & Kerr LLC in Greensburg.
