Lincoln National Life Insurance Company accused of wrongfully denying and processing disability benefits

Insurance 08

PITTSBURGH — An individual is suing Crown Castle USA Inc. and Lincoln National Life Insurance Company for allegedly wrongfully denying disability benefits.

Jean Bittner filed a complaint on April 26 in the U.S. District Court for the Western District of Pennsylvania, alleging that the defendants violated the Employee Retirement Income Security Act.

According to the complaint, the plaintiff alleges that the defendants wrongfully denied her short-term disability benefits and failed to make a decision on whether she was entitled to long-term disability benefits within 45 days, which allegedly is required by law. As a result, she claims that she has suffered financial damages.

The plaintiff requests a trial by jury and seeks past-due disability benefits, plus the costs of this action, interest and attorney's fees and any other just and proper relief. She is represented by Gregory G. Paul of Morgan & Paul PLLC in Pittsburgh.
