Life Insurance Company of North America accused of wrongfully denying disability benefits

PHILADELPHIA — An individual is suing Life Insurance Company of North America for allegedly wrongfully denying her disability benefits.

Carolyn Theurer filed a complaint on April 30 in the U.S. District Court for the Eastern District of Pennsylvania, alleging that the defendant violated the Employee Retirement Income Security Act.

According to the complaint, the plaintiff alleges that she was forced to stop working in 2016 due to her worsening physical impairments. After allegedly receiving benefits for eight months, the defendant allegedly abruptly terminated her benefits in February 2017. As a result, the plaintiff claims that she has suffered financial damages.

The plaintiff requests a trial by jury and seeks to recover benefits under her long-term disability policy, plus pre- and post-judgment interest, attorney's fees, costs and all other relief to which she is entitled. She is represented by Joseph Capitan of Abell & Capitan Law in Philadelphia.
