PITTSBURGH — A woman is suing Robert Morris University and P.J. Dick Inc., claiming insufficient measures were taken to prevent injuries after she fell on a sidewalk at the university.
Dawn Miller filed a complaint May 7 in the Allegheny County Court of Common Pleas, alleging that the defendants failed to adequately maintain and repair the sidewalk on the university's property. P.J. Dick was performing construction work on the campus at the time of Miller's alleged fall.
According to the complaint, the plaintiff was walking on the sidewalk on Jan. 29 when she tripped and fell to the ground, striking her head and left knee. Miller allegedly sustained serious and permanent injuries, including a closed-head injury and concussion, which resulted in severe pain, permanent scarring and lost wages.
The plaintiff claims Robert Morris University and P.J. Dick are responsible because they negligently allowed a dangerous condition to exist on the sidewalk and failed to provide sufficient warning of the resulting danger.
The plaintiff requests a trial by jury and seeks judgment against the defendants in excess of the compulsory arbitration amount set by the court, as well as attorney's fees, costs, interest and other relief. She is represented by Kevin R. O'Malley of O'Malley & Magley LLP in Pittsburgh.
