Quality Touch Home Care facing allegations of breached ownership agreement

PITTSBURGH — A healthcare service provider is suing Quality Touch Home Care LLC, a home health agency, citing alleged breach of fiduciary duty.

Tucked With Care LLC filed a complaint on April 27 in the Allegheny County Courts of Common Pleas against Quality Touch Home Care LLC alleging that the home health agency violated the Uniform Partnership Act and the Revised Uniform Limited Partnership Act.

According to the complaint, the plaintiff alleges that defendant contracted plaintiff's owner to open the Tucked With Care agency in New Jersey, shares of which to be split 50/50. Two months later, the plaintiff was notified that she was only entitled to 10% of the business. 

As a result, the plaintiff has suffered and will continue to suffer substantial damages, it claims. The plaintiff holds Quality Touch Home Care LLC responsible because the defendant allegedly breach the agreement by only giving plaintiff 10% of the company, ceasing communications, paying no money and providing no update on the business, despite providing her signature and namesake to the business.

The plaintiff requests a trial by jury and seeks compensatory and punitive damages, court costs, attorney's fees, pre-judgment interest and such other necessary and proper relief. It is represented by Prabhu Narahari of Kraemer, Manes & Associates LLC in Pittsburgh.
