Class action filed against debt collectors FBCS, Midland Funding

PHILADELPHIA — A consumer has filed a class action lawsuit against debt collectors FBCS Inc. and Midland Funding LLC and 25 John Doe defendants, citing alleged abusive, deceptive and unfair debt collection practices.

Lisa Williams, who is also known as Lisa Guyton, filed the class-action complaint May 21 in the U.S. District Court for the Eastern District of Pennsylvania, alleging that the defendants violated the Fair Debt Collection Practices Act.

According to the complaint, the plaintiff received an initial collection letter from the defendants on June 8, 2017.

Williams alleges that the defendants falsely represented the character and amount of legal status of the debt, and failed to advise her that if she made a payment on the debt the statute of limitations would restart and she could be sued.

The plaintiff requests a trial by jury; and seeks an order declaring that this action is properly maintainable as a class action and certifying Williams as class representative and her counsel as class counsel. Williams also seeks actual and statutory damages, attorney's fees, costs and expenses and other relief deemed just by the court. The plaintiffs are represented by Antranig Garibian of Garibian Law Offices PC in Philadelphia.
