Galway's Pub patron claims dumpster placement led to injuries

MEDIA — A patron is suing Galway's Pub, Pinciotti Rubbish Removal Corp. and Jack Clark Rubbish Removal claiming insufficient measures were taken to prevent injuries.

Carol Locker filed a complaint May 23, in the Delaware County Court of Common Pleas, alleging that the defendants failed to keep the area surrounding a dumpster in a reasonably safe condition.

According to the complaint, Locker was on the defendant's property on June 20, 2016 when she tripped, slipped and fell into a dumpster arm while allegedly trying to avoid a negligently placed parking barrier. The plaintiff claims she sustained injuries to her arm, went into shock, aggravated a pre-existing condition and suffered a significant financial loss.

Locker said the defendants allegedly failed to reasonably inspect the premises, parking lot and dumpster for potential risks, failed to provide adequate lighting and failed to place the dumpster in a safe location.

The plaintiff requests a trial by jury and seeks a judgment in excess of the arbitration limits of the court. She is represented by Jeffrey Rosenbaum of Rosenbaum & Associates PC in Philadelphia.
