PITTSBURGH — A game manufacturer is suing arcade operator Pennsylvania Skill Games LLC for alleged unjust enrichment.
POM of Pennsylvania LLC, which is temporarily doing business as Pace-O-Matic, and Savvy Dog Systems LLC filed a complaint May 31 in the U.S. District Court for the Western District of Pennsylvania. alleging that Pennsylvania Skill Games obtained profit through the use of infringing trademarks.
According to the complaint, the plaintiffs' goodwill and reputation were damaged as a result of the alleged wrongful conduct of the defendant in using the "Pennsylvania Skill" trademark.
The plaintiffs allege that the defendant caused confusion and deceived the public in an effort to divert potential profit.
The plaintiffs request a trial by jury and seek a judgment against defendant for damages, injunctive relief, attorney's fees, costs and other relief as the court deems just. They are represented by Julian E. Neiser and William P. Smith of Spilman Thomas & Battle PLLC in Pittsburgh, Pennsylvania.
