MEDIA - An incapacitated woman's guardians are suing restaurant operator Original Casey's of Drexel Hill Inc.., claiming that the defendant illegal sold liquor to an intoxicated person.
Kathleen Devine Fox and Rocco Spinelli, individually and as guardians of Courtney Spinelli, filed a complaint May 18 in the Delaware County Court of Common Pleas, alleging that Original Casey's violated the Dram Shop Act.
According to the complaint, Courtney Spinelli and her friend P.J. McCollough were in defendant's restaurant on Jan. 5 and Jan. 6. The plaintiffs allege that McCollough lost control of his vehicle as a result of the defendant's negligence and crashed into a tow truck.
Fox and Rocco Spinelli said Courtney Spinelli was critically injured in the accident and was in a coma for about 12 days. They said Courtney Spinelli is now totally disabled and currently requires round-the-clock care.
The plaintiffs claim Original Casey's is responsible for Courtney Spinelli's injuries because its employees negligently continued to serve alcohol to a visibly intoxicated person.
The plaintiffs request a trial by jury and seek compensatory damages of more than $50,000, punitive damages of not less than $50,000, interest and costs of the action. They are represented by Jacqueline Promislo of Cozen O' Connor in Philadelphia.
