&&&Estate administrator blames Golden Living Center for mother's death

READING — An estate administrator is suing Golden Living Center-Reading, which does business as GGNSC Mount Penn LP, alleging that the defendant's liability, negligence and vicarious liability led to the death of her mother.

Nancy Benner, executrix of the estate of her deceased mother Ella White, filed a complaint May 30 in the U.S. District Court for the Eastern District of Pennsylvania, alleging that the defendants breached the professional standard of care and treatment.

According to the complaint, White's survivors have incurred hospital, nursing, medical and funeral expenses and were deprived of the decedent's companionship, comfort, aid, assistance and society, as a result of negligence of the defendants in the lack of adequate care, treatment and monitoring White that allegedly eventually contributed to her death. 

Benner claims Golden Living failed to use care in the maintenance of safe facilities and equipment, failed to properly supervise staff and failed to enforce rules, procedures and policies to ensure quality healthcare.

The plaintiff requests a trial by jury and seeks judgment against the defendant in excess of $50,000, plus punitive damages, costs, expenses and damages for pre-judgment delay. She is represented by Christian J. Hoey of Christian J. Hoey Law Firm in Paoli.

Golden Living and the other defendants are asking the court to order arbitration of the claims and stay the lawsuit.
