Business patron says NHS Human Services failed to inspect faulty bench

MEDIA — A business invitee is suing Merakey USA, which does business as NHS Human Services Inc., alleging that the defendant's negligence resulted in injuries when a bench on which she was sitting flipped.

Antionette Barnes filed a complaint May 30 in Delaware County Court of Common Pleas, claiming that the company failed to maintain its premises in a reasonably safe condition.

According to the complaint, Barnes was injured on Aug. 14, 2017 on the defendant's premises when the bench she was sitting on allegedly flipped and/or broke, resulting in severe and permanent injuries to her right knee, right shoulder, right elbow, right wrist, right hip and right ankle.

The plaintiff said she holds NHS Human Services responsible because it allegedly failed to inspect its premises to see if there were dangerous or defective conditions and failed to provide sufficient warning of any existing danger.

The plaintiff requests a trial by jury and seeks a judgment against the defendant in an amount of not less than $50,000, attorney's fees, costs and other necessary relief. She is represented by David Kwartler of Kwartler Manus LLC in Philadelphia.
