MEDIA - A Pennsylvania woman who alleges her divorce lawyer cost her more than $1 million will have her case heard during a four-week trial term that begins on Dec. 31, according to a May 22 trial assignment and case management order entered by the Court of Common Pleas of Delaware County.
A pre-trial conference for plaintiff Katherine Hoban’s complaint against Knight & Moskow PC is scheduled for Nov. 29. Both parties must complete discovery 60 days before the beginning of the trial term. The deadline for filing a summary judgment request is 45 days before the trial term begins.
Hoban filed a lawsuit May 30, 2017, alleging that Knight & Moskow partner Jean Moskow did not represent Hoban properly in her divorce. Hoban sued for professional negligence and breach of contract.

The lawsuit claims Moskow was hired to represent Hoban in her divorce proceedings with ex-husband, Gregory Smith. Hoban and Smith legally separated in October 2014, and Moskow and Hoban’s attorney-client relationship began in May 2015. The complaint alleges that Moskow was hired to help the plaintiff through the equitable distribution process.
Hoban said she filed her lawsuit because Moskow allegedly did not do all she could to obtain information concerning Smith’s law firm, which was considered an asset in the divorce proceedings. Hoban claims Smith earned $1 million from a case, a number Hoban said should have “been subject to equitable distribution."
Hoban also said in the complaint that, although she was awarded 60% of the profit from selling the home she owned with Smith, she was not able to obtain a profit in the post-closing process.
The lawsuit said Hoban was denied equitable distribution of more than $1 million and was ordered to pay Smith for a $42,000 personal tax debt.
