LANCASTER - A customer is suing flooring company Certified Carpet Service Inc., alleging that insufficient measures were taken to prevent injuries at the defendant's store.
Lada Nydam filed a complaint May 2 in Lancaster County Court of Common Pleas, claiming that Certified Carpet failed to maintain its store premises so it was safe for customers.
According to the complaint, Nydam was injured on Sept. 30, 2016 while shopping at the defendant's store when she fell as she was walking from the upper level of the store to the lower level. The plaintiff claims she sustained injuries to her right rotator cuff and right arm.
Nydam said Certified Carpet is responsible for her injuries because it allegedly was negligent in allowed a known dangerous condition to continue without corrective actions and failed to warn customers of the potential danger.
The plaintiff requests a trial by jury and seeks compensatory and punitive damages, plus costs and interest. She is represented by Shawn P. McLaughlin of Trinity Law in York.
