Man allegedly shot by Johnsonburg police officer

PITTSBURGH — A man is suing the Borough of Johnsonburg and Police Officer David Cuneo, citing alleged assault and battery.

Angel Perez Jr. filed a complaint June 18 in the U.S. District Court for the Western District of Pennsylvania, alleging that the defendants violated the 14th Amendment to the U.S. Constitution.

According to the complaint, Perez was allegedly assaulted by Cuneo on Nov. 20, 2017, receiving a bullet wound to his spine, a right T12-L1 facet fracture, mild traumatic brain injury, high voltage electric shock, nervousness, emotional tension, anxiety, Post-traumatic Stress Disorder and depression.

The plaintiff claims Cuneo attacked, struck, kicked, punched, bludgeoned, beat and repeatedly shocked him with a taser and shot him in the back while he was attempting to flee for fear of his life.

The plaintiff requests a trial by jury and seeks punitive damages, court costs, interest and other relief permitted by the court. He is represented by Joshua Licata and Peter Friday of Friday & Cox, LLC in Pittsburgh.
