Veolia Energy claims incorrect valve markings caused explosion

PHILADELPHIA — A steam and power supplier is suing Flowserve US Inc., a flow control manufacturer, citing alleged negligence and manufacturing defect.

Veolia Energy Philadelphia Inc. filed a complaint June 14 in the U.S. District Court for the Eastern District of Pennsylvania, alleging that the defendant failed to properly mark the direction of the gas flow on a valve.

According to the complaint, the installed the defendant's Flowserve Valdisk Air Actuated Butterfly Valve to its main control isolation system in March 2016.

Because the defendant's product was allegedly defective, Veolia claims unconsumed gas entered the heat recovery steam generator and caused an explosion, resulting in $2,387,538.09 in damages.

Veolia said Flowserve shoudl be held responsible for the damage because it allegedly failed to properly and safely design and manufacture the valve that indicates the direction of the flow of gas and failed to properly and safely inspect and test the valve before distribution.

The plaintiff requests a trial by jury and seeks a judgment against the defendant in the amount of $2,387,538.09, plus punitive damages, interest, fees, costs and other relief. It is represented by Howard Rothenberg of Howard Rothenberg & Associates in Scranton.
