SCRANTON — State Farm Fire & Casualty Co. is suing IDC Management Co., which does business as M&M Services, citing alleged negligence.
State Farm filed the lawsuit on behalf of insured party Thomas Uhlien June 25, in the U.S. District Court for the Middle District of Pennsylvania, alleging that the defendant breached its duty to prevent damage to Uhlien's property.
According to the complaint, a June 29, 2017 fire caused substantial loss and damage to Uhlien's property, which is insured by State Farm, as a result of M&M Services' alleged negligence and carelessness. State Farm said the fire did more than $250,000 in damage to the insured property.
The plaintiff said the defendant is responsible for the damage because its employees, technicians and subcontractors allegedly used and/or disposed of cigarettes and failed to properly extinguish them.
The plaintiff requests a trial by jury and seeks a judgment in an amount in excess of $250,000, plus costs, delay damages, attorney's fees and other appropriate relief. It is represented by Daniel de Luca of de Luca Levine LLC in Blue Bell.
