Giant Eagle customer blames company for pallet accident

PITTSBURGH — A customer is suing supermarket operator Giant Eagle Inc., citing alleged negligence.

Rita Covone filed a complaint June 15 in the Allegheny County Courts of Common Pleas, claiming that Giant Eagle breached its duty to protect its customers against any known danger.

According to the complaint, Covone was shoppoing at a Giant Eagle store on Jan. 24, 2017 when her right foot hit a protruding pallet, allegedly causing her to fall and land on her head. The plaintiff said she suffered severe concussion, cognitive impairment, ocular dysfunction and other serious injuries.

Covone said the defendant allegedly failed to properly inspect the pallet guard and failed to fix or remove it.

The plaintiff requests a trial by jury and seeks damages in an amount in excess of the jurisdictional limits of the court, reimbursement of lost earnings, interest, attorney's fees, costs and other appropriate relief. She is represented by Andrew Flenner of Romanow Law Group in Pittsburgh.
