Delaware County claims Primo's owes $28,180 under cafeteria contract

MEDIA — Delaware County is suing Primo's Grille Inc., doing business as Primo's Grille and as Primo's Catering, citing alleged breach of contract.

The county filed a complaint in the Court of Common Pleas of Delaware Count, alleging that the defendant has not made payments on a cafeteria operations contract since Jan. 1 and has not reported its gross sales and vending sales.

According to the complaint, the county awarded a contract to Primo's on Oct. 21, 2015 for cafeteria operations at the courthouse and government center in Media, with a rental fee of $950 per month. In addition, the county said the contract requires Primo's to pay 9% of its gross sales and 15% of the gross sales of vending.

The county said it has made several demands for payment of the $28,180.06 due under the contract.

The plaintiff seeks the principal amount of $28,180.06, plus interest, costs and other relief the court deems just. It is represented by Matthew Bilker of Eckell, Sparks, Levy, Auerbach, Monte, Sloane, Matthews & Auslander PC in Media.
