Patient accuses Aspen Dental of negligence following tooth extraction

HARRISBURG — A New Jersey resident is suing Dr. Neelam Attri, Aspen Dental Associates of Nepa PLLC and Aspen Dental Management Inc., citing alleged failure to obtain informed consent, negligence and vicarious liability.

Joseph Hanko filed a complaint June 29, in the U.S. District Court for the Middle District of Pennsylvania, alleging that the defendants failed to exercise standard care and skill required of medical providers and medical facilities.

According to the complaint, Hanko developed complications on July 6, 2016 following a tooth extraction and was required to undergo additional surgery, suffered from mental anguish, continued to have pain and suffering and incurred substantial and unnecessary medical bills. 

Hanko said the defendants should be held responsible because they allegedly failed to properly perform the extraction and failed to adequately supervise his post-operative treatment.

The plaintiff requests a trial by jury and seeks a judgment in an amount in excess of $150,000, as well as all other relief the court deems proper. He is represented by Thomas Sacchetta of Sacchetta & Baldino in Media, Pennsylvania.
