Patient blames Allegheny Health Network, doctor for post-procedure complications

PITTSBURGH — A patient is suing Dr. Manish Dhawan, the Allegheny Health Network and Forbes Regional Hospital, citing alleged negligence.

Marilyn Garczynski filed a complaint June 21 in the Allegheny County Court of Common Pleas, alleging that the defendants breached the professional standard of care and treatment.

According to the complaint, Garczynski complained on July 1, 2016 of chest pressure, pain and discomfort, hoarseness and shortness of breath after an endoscopy procedure and was allegedly later discovered to be suffering from complications, including difficulty eating, pain and discomfort, outpouching of her esophagus and pressure in her neck. 

The plaintiff said the defendants should be held responsible because they allegedly applied inappropriate force to the scope in an attempt to move it down her esophagus.

The plaintiff requests a trial by jury and seeks a judgment for an amount in excess of the arbitration limits. She is represented by Charles Evans and Carolyn Boucek of Meyers Evans Lupetin & Unatin LLC in Pittsburgh, Pennsylvania.
