Couple blames Wheel Fun Rentals for Segway malfunction

PHILADELPHIA — A New Jersey couple is suing Freetime Inc. and Wheel Fun Rentals, citing alleged negligence.

Rebecca Tracey and George Tracey filed a complaint July 12 in Philadelphia County Court of Common Pleas, alleging that the defendants failed to keep their Segways in a reasonably safe working condition.

According to the complaint, Rebecca Tracey and several others rented Segways from the defendants at Independence Mall on Oct. 6, 2016. While on a tour, Rebecca Tracey claimed her Segway malfunctioned, causing her to be thrown to the ground and suffer a knee fracture, sinus fracture and left orbital wall fracture. George Tracey alleges that he has been deprived of the society and consortium of his wife.

The Traceys said the defendants should be held responsible because they allegedly failed to regularly inspect the Segway rented to Rebecca Tracey to diagnose and correct mechanical problems and negligently allowed her to use the segway despite notice of malfunctioning.

The plaintiffs request a trial by jury and seek a judgment in an amount in excess of $50,000. They are represented by Benjamin Simmons of Defino Law Associates PC in Philadelphia.
