PHILADELPHIA — An electronics technician is suing National Railroad Passenger Corp., which does business as Amtrak, claiming that the company maintained an unsafe work environment.
Joseph Rash filed a complaint July 11 in the U.S. District Court for the Eastern District of Pennsylvania, alleging that Amtrak violated the Federal Employers' Liability Act.
According to the complaint, Rash was injured on Dec. 27, 2017 while working in the material control room of Amtrak's Penn Station in New York. The plaintiff alleges that he suffered serious and permanent injuries to his right arm and elbow.
Rash said Amtrak should be held responsible for his injuries because co-worker Robert McCarthy allegedly failed to comply with Amtrak's safety policies when he suddenly and without warning pulled a cable while Rash was holding it.
The plaintiff requests a trial by jury and seeks a judgment in an amount in excess of $150,000. He is represented by Michael Olley and Lawrence Katz of Coffey Kaye Myers & Olley in Bala Cynwyd.
