PHILADELPHIA — A New Jersey contractor is suing The Pep Boys - Manny Moe and Jack, also known as Pep Boys, citing alleged breach of an agreement.
Nest International Inc. filed a complaint July 11 in the U.S. District Court for the Eastern District of Pennsylvania, alleging that the automotive retailer violated the New Jersey Prompt Payment Act.
According to the complaint, between Aug. 16, 2017 and Feb. 2, 2017, Nest performed facility restoration and/or renovation services for the defendant. After all proper credits for payments were applied, the lawsuit claims Pep Boys still owes Nest $283,865.74 for the work performed.
The plaintiff requests a trial by jury and seeks all damages, pre-judgment and post-judgment interest, attorney's fees, costs and expenses and other proper relief. It is represented by Gavin Lentz and Albert Belmont III of Bochetto & Lentz PC in Philadelphia.
