Pedestrian claims CAD Holdings failed to salt sidewalk after ice storm

Slip01

PHILADELPHIA — A pedestrian is suing Thomas Olick and CAD Holdings LLC, citing alleged negligence.

Tammy Payesko filed a complaint July 16 in the U.S. District Court for the Eastern District of Pennsylvania, alleging that the defendants failed to properly address a freezing rain storm that occurred on Feb. 7.

According to the complaint, Payesko was allegedly injured on Feb. 8 when she slipped and fell on ice on the sidewalk of the defendants' property. The plaintiff said she sustained a severe and permanent injury to her left ankle and suffered severe shock to her nervous system.

Payesko said the defendants allegedly failed to adequately salt the sidewalk, failed to remove the ice and failed to give adequate warning of the accumulated ice.

The plaintiff requests a trial by jury and seeks a judgment in a sum in excess of $150,000, plus costs, pre-judgment and post-judgment interest and all other relief allowed by law. She is represented by Adam Wilf of Lundy Law LLP in Philadelphia.
