Cancer-stricken UPS employee sues company for disability discrimination

HARRISBURG — An operations manager who was diagnosed with liver cancer is suing United Parcel Service Inc. Harrisburg and United Parcel Service Inc. Atlanta, citing alleged violation of the Family and Medical Leave Act.

Eric Gorman filed a complaint on July 27, in the U.S. District Court for the Middle District of Pennsylvania, against the defendants, alleging that they violated the Americans with Disabilities Act and the Pennsylvania Human Relations Act.

According to the complaint, the plaintiff alleges that in or around January 2017, he was diagnosed with liver cancer. He was fired from his job on Jan. 18, 2017. He has suffered great economic loss for lost wages and lost of future earnings, emotional distress, humiliation and pain and suffering, according to the complaint. 

The plaintiff holds United Parcel Service Inc. Harrisburg and United Parcel Service Inc. Atlanta responsible because the defendants allegedly failed to engage in meaningful discussion to accommodate his disability and terminated his employment after he was diagnosed with a disability.

The plaintiff requests a trial by jury and seeks compensatory and punitive damages, attorney's fees, costs, interest and such other just and proper relief. He is represented by Graham F. Baird of Law Offices of Eric A. Shore PC in Philadelphia.
