PITTSBURGH — A legal service provider is suing Michael E. DiNatale and My Exchange Services Inc. citing alleged breach of service agreement.
Frank, Gale, Bails, Murcko & Procrass PC filed a complaint on July 17, in the Allegheny County Courts of Common Pleas, against the defendants alleging that they wrongfully retained possession of his confidential information.
According to the complaint, the plaintiff alleges that as plaintiff's IT provider, the defendant had possession of plaintiff's confidential email address and highly sensitive information.
As a result of defendant's refusal to cooperate, the plaintiff has suffered and will continue to suffer irreparable harm. The plaintiff holds Michael E. DiNatale and My Exchange Services Inc. responsible because the defendants allegedly refused to relinquish possession and control over plaintiff's office 365 email account and failed to cooperate with plaintiff's new IT provider.
The plaintiff requests a trial by jury and seeks judgment in an amount over $35,000, immediate possession of its existing office 365 email system, compensatory damages, attorney's fees, costs and expenses and such other proper and just relief. It is represented by Jay N. Silberblatt of Silberblatt Mermelstein PC in Pittsburgh.
