Lawsuit filed against W&D Imports claims fraud in sale of pre-owned Maserati

PHILADELPHIA — A law firm has filed a lawsuit against W&D Imports Inc. doing business as Davis Honda, an used automobile distributor, citing alleged fraud involving the sale of a pre-owned Maserati.

Marino & Associates Inc. filed a complaint on July 31, in the U.S. District Court for the Eastern District of Pennsylvania, against W&D Imports Inc. alleging that the used automobile distributor fraudulently misled plaintiff to induce it to enter into a sales contract.

According to the complaint, the plaintiff alleges that on Nov. 13, 2017, he purchased a pre-owned 2014 Maserati Ghibli SQ4 from defendant for $45,619.76. 

Shortly after purchase, the right front headlight of the Maserati malfunctioned and residue of fluid seeped from the radiator. Upon presentation of the vehicle to an authorized dealer, the plaintiff was informed that it had been severely damaged in a front-end collision and had been improperly repaired.

 The plaintiff holds W&D Imports Inc. d/b/a Davis Honda responsible because the defendant allegedly represented and guaranteed that the pre-owned vehicle was not involved in a front end collision.

The plaintiff requests a trial by jury and seeks refund of all monies paid to defendant, compensatory and treble damages, attorney's fees, costs and such other appropriate relief. He is represented by Joseph Auddino of Marino & Associates PC in Philadelphia.
