MEDIA — A daughter and mother are suing the Community YMCA of Eastern Delaware County and Upper Darby School District, after an alleged fall from bleachers at the Beverly Hills Middle School.
Akira Smith, a minor, by and through her parent and natural guardian, Sarina Smith, and Sarina Smith in her own right filed a complaint on July 27 in the Delaware County Court of Common Pleas against the defendants alleging that they failed to maintain the school premises in a reasonably safe condition.
The plaintiffs allege that on Aug. 1, 2016, Akira Smith was at Beverly Hills Middle School when she was injured when she fell while climbing a set of bleachers. She sustained injuries resulting in great pain and suffering, mental anguish, frustration, anxiety and embarrassment, the suit says.
The plaintiffs hold Community YMCA of Eastern Delaware County and Upper Darby School District responsible because the defendants allegedly negligently allowed a defective and dangerous condition to exist in the school premises and failed to erect appropriate barriers or barricades to prevent persons from falling.
The plaintiffs request a trial by jury and seek judgment against the defendants, jointly and severally, in an amount of not less than $50,000, plus interest, costs and such other just and appropriate relief. They are represented by Kenneth S. Saffren of Saffren & Weinberg in Jenkintown.
