Wells Fargo claims Kaushas owes $39,434 following account overdraft

WILKES-BARRE — Wells Fargo Bank NA is suing the Law Office of EJ Kaushas and Edward J. Kaushas, citing alleged breach of contract, breach of warranty and fraud.

Wells Fargo filed a complaint July 25 in Luzerne County Court of Common Pleas, alleging that the defendants breached their duties of good faith and fair dealings.

According to the complaint, on March 16, Kaushas failed to deposit $40,000 drawn on his personal bank account at CMC-FCPI Employees Federal Credit Union into a Wells Fargo account to cover a payment made to Hashtag Holdings LLC.

Wells Fargo claims Kaushas knew the credit union account was closed and that his deposit check would return unpaid.

The plaintiff requests a trial by jury and seeks compensatory damages in the amount of $39,433.65, which equals the overdraft amount and interest, as well as further relief as the court deems just. It is represented by Maura Burke of Fox Rothschild LLP in Philadelphia.
