PITTSBURGH — A pharmacy management and ancillary software solutions company is suing medical retailer Pharmacy Specialist Inc., citing alleged breach of contract.
SoftWriters Inc filed a complaint in the Court of Common Pleas of Allegheny County Pennsylvania, alleging that Pharmacy Specialist has refused its offer to discuss and possibly resolve the defendant’s allegedly unsupportable claim that the FrameworkLTC software does not meet the store's business needs.
In addition, SoftWriters claims the defendant has not negotiated in good faith to resolve payment due under a new contract between the parties
According to the complaint, between Aug. 4, 2017 and June 19, SoftWriters and Pharmacy Specialist executed a multiple-pharmacy software license and maintenance agreement, which included three days of onsite training.
However, the plaintiff alleges that the defendant’s personnel refused to complete the full training needed to properly install and use the FrameworkLTC platform.
SoftWriters said it continued to offer support and assistance to the defendant, but did not hear from Pharmacy Specialist until it received an email making the allegedly false claims that SoftWriters had failed to deliver FrameworkLTC and provide training The defendant also sought to terminate the contract and demanded a full refund.
The plaintiff seeks compensatory damages in an amount in excess of $50,000, plus interest, costs, attorney's fees and punitive damages. It is represented by David Marion and Linda Perkins of White and Williams LLP in Philadelphia, Pennsylvania.
