PHILADELPHIA — Baby Merlin Co. is suing CribCulture LLC and manager Isaiah Blackburn, citing alleged trademark infringement, unfair competition, false designation of origin, false advertising and violation of Pennsylvania’s Unfair Trade Practice And Consumer Protection Law.
Baby Merlin filed a complaint Aug. 3 in the U.S. District Court for the Eastern District of Pennsylvania, alleging that the defendants copied key patented design features of Baby Merlin’s Magic Sleepsuit swaddle-transition technology and introduced a competing product.
According to the complaint, Magic Sleepsuit trademarks or similar marks that are likely to be confused with those trademarks were allegedly placed on the defendant’s website, Amazon’s platform and social media without authorization or license.
Baby Merlin claims the defendants also allegedly have falsely advertised that their swaddle-transition product is “patented."
The plaintiff requests a trial by jury and seeks monetary damages, punitive damages, attorney's fees and costs. It is represented by Robert Axenfeld of Axenfeld Law Group LLC in West Chester, Pennsylvania.
