A Philadelphia resident seeks more than $75,000 in damages after allegedly falling down on sidewalk

PHILADELPHIA — A Philadelphia resident, claiming she tripped and fell on a sidewalk, is seeking more than $75,000 in damages from the U.S. Army, Gaudenzia Inc., the city of Philadelphia and Kerr Building Materials Inc., property operators, citing alleged negligence.

Juanita Green filed a complaint on Aug. 3, in the U.S. District Court for the Eastern District of Pennsylvania,  against the defendants alleging that they failed to use due care to maintain premises in a safe condition.

The plaintiff alleges that, on October 21, 2015, while she was on the sidewalk of property owned, managed and maintained by the defendants, she tripped and fell to the ground, suffering injuries.

The sidewalk was adjacent to 15th Street between Washington Avenue and Alter Street, according to the complaint.

"As a result of defendant's carelessness, plaintiff was caused to sustain various internal and external serious and permanent injuries in and about her head, body, limbs and psyche, suffered great pain and agony, prevented her daily duties and occupation, and incurred financial damage and loss," the complaint states. 

The plaintiff holds the United States of America, Department of the Army, Gaudenzia Inc. t/a Gaudenzia Washington House, City of Philadelphia and Kerr Building Materials Inc. responsible because the defendants allegedly failed to properly maintain, inspect and correct the property and its premises, and failed to give sufficient warnings to plaintiff and/or others as to the highly dangerous conditions of the premises.

The plaintiff requests a trial by jury and seeks judgment against defendants in an amount in excess of $75,000, plus interest and costs.
