Tractor trailer owner allegedly injured in cargo spill sues storage facility

PHILADELPHIA — A tractor trailer owner is suing Exide Technologies Inc., citing negligence, after he was allegedly injured in a cargo spill.

Claude Moore filed a complaint on Aug. 14, in the U.S. District Court for the Eastern District of Pennsylvania against Exide Technologies Inc., alleging that the Georgia corporation failed to ensure that the cargo was loaded safely and securely.

The plaintiff alleges that, on Sept. 29, 2016, while attempting to unload the cargo at defendant's facility in Salina, Kansas, several pallets fell out of the trailer, knocking him to the ground and pinning him under the pallets. 

He suffered injuries including but not limited to lower back pain, neck pain, headaches and right ankle fracture. The plaintiff holds Exide Technologies Inc. responsible because the defendant allegedly prevented him from leaving the cab of his trailer-tractor, did not give him the opportunity to inspect the load and failed to secure the load at the rear of his trailer-tractor.

The plaintiff requests a trial by jury and seeks judgment against the defendant in an amount in excess of $150,000. with interest and costs. He is represented by Scott B. Cooper of Schmidt Kramer PC in Harrisburg.
