PITTSBURGH — A worker is suing Home Depot USA, Inc., citing alleged negligence-premises liability, claiming he was injured while unpacking boxes at the home improvement store.
Christopher McCrory filed a complaint on Aug. 23, in the Court of Common Pleas Allegheny County, against Home Depot USA, alleging that the home improvement store stacked boxes in a manner that created a risk and hazard.
The plaintiff alleges that, on April 10 he was at the defendant's premises to complete an assembly project. While he was unboxing and assembling grills, boxes were stacked five-high by Home Depot on a pallet and weighed over 100 pounds each, he claims.
The fifth box on top of the pallet fell onto McCrory, who sustained injuries including but not limited to torn tendons in his right wrist. The plaintiff holds Home Depot USA, Inc. responsible because the defendant allegedly failed to provide safety specifications identifying fall hazards that created risks during the assembly project.
He claims Home Depot should have had methods in place to prevent injuries that could result from those hazards, thereby violating recognized safety standards and practices.
The plaintiff requests a trial by jury and seeks an amount in excess of $35,000.00 and any such other relief the court deems adequate, just, and proper. He is represented by Anthony J. Giannetti and Brandon A. Swartz of Swartz Culleton PC in Pittsburgh, Pennsylvania.
