Bracey's Supermarket faces lawsuit over alleged retaliation toward pharmacist

SCRANTON — A pharmacist is accusing a supermarket chain of retaliating against her after she refused to fill an invalid prescription.

Cheryl Judge-Wilson filed a complaint on Aug. 17 in the Lackawanna County Court of Common Pleas against Bracy's Supermarket Inc., alleging wrongful discharge

According to the complaint, Judge-Wilson did not dispense phenobarbital, a controlled substance, to a customer, because he did not have a valid prescription. Judge-Wilson alleges her manager told her to, but she refused. In response, she says, the manager gave her a disciplinary notice. 

Afterward, Judge-Wilson was refused days off and forced to resign, the complaint states. Judge-Wilson claims she has experienced serious health problems due to the situation. 

Judge-Wilson requests a trial by jury and seeks damages of more than $50,000.00, plus costs. She is represented by Kimberly D. Borland of Borland and Borland in Wilkes-Barre.
