MEDIA — Clients are suing attorney Kenneth Mark Sexton, citing alleged professional liability.
Rosalie Amen and Francesca Dellosa filed a complaint on Sept. 6, in the Delaware County Court of Common Pleas, against Kenneth Mark Sexton, alleging that the lawyer failed to take any action with respect to the rule to file complaint.
According to the complaint, on Nov. 14, 2013, Rosalie Amen and Francesca Dellosa were involved in a accident in Marple Township when the at-fault driver fell asleep on the wheel.
They allegedly sustained serious injuries and incurred various expenses and damages. The defendant agreed to represent them in the ensuing litigation, they say.
As a result of the defendant's alleged inaction, they were unable to recover compensation for their injuries and damages, according to the complaint. The plaintiffs hold Kenneth Mark Sexton responsible because the defendant allegedly never filed a complaint on their behalf and never advised them of receiving a notice of intent to enter judgment of non pros from the at-fault driver's counsel.
The plaintiffs request a trial by jury and seek judgment in their favor in an amount greater than $50,000, exclusive of interest, costs, punitive damages and such other just and appropriate relief. They are represented by Gerald J. Mullaney Jr. of Mullaney & Mullaney LLC in Skippack.
