Wrongful term 03

NEW CASTLE — A former employee is suing Bancroft Neurohealth, a nonprofit corporation, citing alleged retaliation and wrongful termination.

Lusu Gbarjuewaye filed a complaint on Aug. 30 in the Delaware County Court of Common Pleas against Bancroft Neurohealth, alleging the nonprofit corporation breached its duty of good faith and fair dealings.

According to the complaint, the plaintiff alleges that on May 15 she sustained loss of earnings, loss of back pay, front pay and interest, and suffered emotional distress, humiliation, embarrassment, and loss of self-esteem from being abruptly terminated from her employment on false allegations that she had falsified documentation, when in fact plaintiff was relieved from her job as retaliation for reporting misappropriation of funds and an assault incident that involved defendant's employee and a resident of defendant's Highland Home located at Broomall in Pennsylvania.

The plaintiff holds Bancroft Neurohealth responsible because the defendant allegedly terminated plaintiff in bad faith without reasonable grounds and retaliated against plaintiff for registering complaints of wrongdoing she has witnessed.

The plaintiff requests a trial by jury and seeks judgment against defendant for an amount in excess of $50,000, together with interest, costs of suit and attorney's fees. She is represented by Sidney Gold of Sidney L. Gold & Associates PC in Philadelphia.
