SCRANTON — A liability insurer is suing A.O. Smith Water Product Co., a water heater manufacturer, citing alleged design and manufacturing defect.
All State Insurance Co., a/s/o Joann Turano, filed a complaint on Sept. 10 in the Lackawanna County Court of Common Pleas against A.O. Smith Water Product Co., alleging the water heater manufacturer negligently placed defective water heaters in the stream of commerce.
According to the complaint, the plaintiff alleges that on July 3, 2017, plaintiff's insured property located at 112 Hill St. in Dunmore sustained water damage when defendant's water heater leaked. As a result, plaintiff paid its insured the sum of $6,665.15. The plaintiff holds A.O. Smith Water Product Co. responsible because the defendant allegedly failed to use safe component parts in manufacturing water heaters and failed to provide adequate warning and/or instructions on its water heaters.
The plaintiff requests a trial by jury and seeks judgment against the defendant in the amount of of $6,665.15, plus interest and costs. It is represented by Paul Sandler of Sandler & Marchesini PC in Philadelphia.
