PHILADELPHIA — A man has filed a class action lawsuit against Research America Inc. and Does 1-10, marketing research company, citing alleged violation of the Telephone Consumer Protection Act (TCPA).
John Kristensen filed a complaint individually and on behalf of all others similarly situated on Sept. 17, in the U.S. District Court for the Eastern District of Pennsylvania against the defendants alleging that they violated TCPA through intrusive and unwanted calls.
The plaintiffs allege that in May, John Kristensen and members of the class were harmed - including invasion of their privacy, certain cellular telephone charges and reduced cellular telephone time - by the unlawful acts of the defendant, which sought research gathering surveys via unsolicited text messages.
The plaintiffs hold Research America Inc. and Does 1-10, responsible because the defendants allegedly failed to obtain prior express consent from plaintiff and class members to send unsolicited text messages, and invaded plaintiff and class members' rights to privacy and seclusion.
The plaintiffs request a trial by jury and seek judgment against defendant for statutory damages, injunctive relief, and other relief the court may deem just. They are represented by Cynthia Z. Levin of The Law Offices of Todd M. Friedman PC in King of Prussia.
